Ex-Detroit mayor wants stripper lawsuit thrown out

DETROIT — Lawyers for former Detroit Mayor Kwame Kilpatrick say dozens of interviews have failed to turn up any evidence he obstructed the investigation into the slaying of a stripper who was sprayed with bullets in a drive-by shooting in 2003.
Kilpatrick’s legal team wants a judge to dismiss a lawsuit filed by Tamara Greene’s family. The 40-page document is his most comprehensive response to allegations that have dogged him in and out of city hall.
It was filed under seal last week, but U.S. Chief District Judge Gerald Rosen ordered it unsealed Wednesday.
Greene’s relatives are suing the city of Detroit and Kilpatrick, claiming they stifled the probe when he was in office and violated the family’s civil rights. No one has been charged in her fatal shooting.

Detroit — A motion by former Mayor Kwame Kilpatrick to dismiss a federal lawsuit filed by the family of a stripper slain six months after allegedly dancing at a rumored Manoogian Mansion party was made public today by a federal judge.
Chief U.S. District Judge Gerald E. Rosen also today ordered the city of Detroit to publicly file a motion to dismiss the lawsuit brought by the family of Tamara “Strawberry” Greene, who was shot to death in Detroit in April 2003. Her death remains unsolved.
Kilpatrick’s lawyer James Thomas wrote in his pleadings released today that when “extensive discovery” of evidence and questioning of witness in depositions recently concluded, “Not one witness could confirm that Mr. Kilpatrick either obstructed, impeded or interfered with the Tamara Greene homicide investigation.”

GRAND RAPIDS (WZZM) — Troy Brake, the man convicted of killing four people in their Ottawa County home in 2008, lost his appeal of a separate sexual assault of a prostitute in Kent County.
Brake was convicted last year for the September 2008 deaths of Sharmaine Zimmer, her sons Tyler and Jeremy, and Jeremy’s girlfriend Katherine Brown. Brake shot and killed the Zimmers, then beat and raped Brown before setting the Zimmers’ Wright Township home on fire. He was convicted for the murders in May 2009, and sentenced to life in prison without the possibility of parole.
Two weeks after the murder, Brake was arrested for the attack on a prostitute in Grand Rapids. Brake picked up the woman in his pickup truck, then beat and raped her. The woman escaped, leading to a police search and Brake’s arrest.

GRAND RAPIDS, Mich. (WOOD) – The man serving time behind bars for the murders of four people is trying for an appeal on a separate conviction.
Now he is appealing, saying he was drunk and retaliating for what he believed was a robbery attempt, and that he did not intend to kill anyone.
In addition to that case, Brake is serving life in prison for the shooting deaths of Sharm Zimmer, her sons, Jeremy and Tyler, and Jeremy’s girlfriend, Katherine Brown, in the Zimmers’ Wright Township home in September 2008.

DETROIT (AP) – Former Detroit Mayor Kwame Kilpatrick’s request to dismiss a lawsuit filed by the family of a slain stripper will not be sealed from the public.
Chief federal Judge Gerald Rosen has read the court filing and says it matches a similar filing by the city of Detroit, also a defendant in the case. Rosen told Kilpatrick’s lawyer to promptly file a public version Wednesday.
Tamara Greene’s family is suing Detroit and Kilpatrick, claiming they stifled the homicide investigation. She was fatally shot while sitting in a car in 2003.
The city says there was no coverup and that Greene died because of a feud between drug dealers.
There’s an allegation – never proved – that Greene danced at the mayoral mansion in 2002 and was attacked by Kilpatrick’s wife.

Public will get peek at motion to dismiss stripper lawsuit

A federal court judge today ordered the city of Detroit to publicly file a motion to dismiss a lawsuit filed by the family of a stripper who allegedly danced at a rumored Manoogian Mansion party.
Chief U.S. District Judge Gerald E. Rosen said filing the city’s motion and brief under seal is moot because a nearly identical version was briefly posted on the court’s computerized docket last week and published in the Detroit Free Press.
But Rosen ordered numerous exhibits accompanying the summary judgment motion remain sealed pending court review. He also granted the city’s request to exceed a 20-page limit for the summary judgment motion.
The motion seeks to dismiss a lawsuit brought by the family of Tamara “Strawberry” Greene, who was shot to death in Detroit in April 2003. Her death remains unsolved.

Gillotti added many of the caregivers that city officials have spoken with said their preferred method of providing medication was delivering to the patients.
Council Member Brian Robb expressed concerns over restricting patients from picking up their medicine from caregivers’ homes.
“I’m not thrilled that you don’t want five people to come over to my house to get medicine,” he said.
Gillotti said the planning commission is considering recommending home businesses and dispensaries remain 1,000 feet from schools and dispensaries remain 500 feet from one another, though home businesses wouldn’t be required to remain 500 feet apart.
Robb questioned that approach as well and said it felt like dispensaries were being treated like adult establishments, such as strip clubs or adult bookstores.

Detroit — Police shot a man who opened fire on officers this morning as they investigated a suspected burglary at an east-side strip club.
Officers from the Eastern District were responding to a burglary alarm and saw the front door of Club 007 ajar about 6:30 a.m., Detroit Police Sgt. Eren Stephens said.
When officers went inside the club on East Outer Drive, a man shot at them, Stephens said. The officers fired back, striking the man at least once, she said, citing preliminary information.
The man was taken to an area hospital with injuries not believed to be life threatening, Stephens said.
Relatives identified the man as Kareem Hall.

DETROIT – An armed robber was shot by police outside a Detroit strip club early Wednesday morning.
Detroit police tell FOX 2’s Al Allen that they responded to a breaking and entering call at Club 007 on E. Outer Drive and 7 Mile around 6:30 a.m. The robber, who ran into police near the club’s entrance, pulled a gun and fired several shots. Police returned fire, hitting the suspect.
He was taken to an area hospital and his condition is unknown at this time.
